Hi!

I received an estimate from a house painter, and was surprised to see
that he included sales tax (not just on the paint, but on the entire
job). A quick search of Usenet and of the web in google, and it seems
that sales tax on services varies from state to state and type of
service to type of service. but I couldn't find anything about this
issue in New York. Anybody familiar with painting services in New York
and whether or not a homeowner should expect to pay sales tax to a
house painter? Thanks!

I'm an ex-NYer but if my memory serves me right, any capital improvement on
a house is not taxable. The painter is supposed to supply a tax exempt form
for you to sign.

I'm an ex-NYer but if my memory serves me right, any capital improvement on
a house is not taxable. The painter is supposed to supply a tax exempt form
for you to sign.
Painting is not a capital improvement and it is taxable.
"Sales of tangible personal property and some services are subject to NYS
Sales Tax.
Taxable services include: repairing property, landscaping, painting, general
repairs of real property, faxing service, sale of a pet, video taping,
cleaning or maintenance services, sale of food or drink in or by a
restaurant. Those who provide Internet services should contact NYS Sales Tax
at
1-800-972-1233 for the taxable consequences of their particular service. "

Call the NY State Dept of Taxation & Finance if you still don't trust
anyone. What did the other estimates say?

I am amused as to how often people think that someone is "ripping tem
off" on sales tax. We own a restaurant that does a lot of take-out
business; in some states apparently this isn't taxed, because we have
had customers throw a fit that they were charged tax. But everybody
is.

Now, is a merchant collects tax and then doesn't remit it to the State
- well, that is a crime on the part of the merchant. But its hardly
the customer's business - the customer DID owe tax after all. Kind of
like, how do you know that they paid their income tax either - not
your problem.

I'm a current NY-er and house painting is *maintenance*, not capital
improvement.
